Their frequency depends on:<br>- the type of job position,<br>- working conditions and harmful factors,<br>- the individual decision of the occupational medicine physician.<br><br>The employer must ensure:<br>- examinations at the company\u2019s expense,<br>- referral from your employer,<br>- the right to retain pay for the time spent on examinations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-ast-global-color-8-color has-text-color has-link-color wp-elements-930cab68b7e361185dabaaa7a2bba6ce\" style=\"margin-bottom:var(--wp--preset--spacing--30)\"><strong><strong><strong>Control medical examinations \u2013 after prolonged absence<\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"has-ast-global-color-8-color has-text-color has-link-color wp-elements-5c97538005dcd207667f370b7f7d5405 wp-block-paragraph\" style=\"margin-bottom:var(--wp--preset--spacing--70)\">Control medical examinations apply to people returning to work after an illness lasting more than 30 days. Their purpose is to confirm the ability to work in the previous position. As with periodic examinations:<br>- the examinations are carried out at the employer\u2019s expense,<br>- they should take place during working hours,<br>- the employee retains the right to remuneration.<br><br>Without a valid medical certificate, the employee cannot be allowed to work.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-ast-global-color-8-color has-text-color has-link-color wp-elements-4aeab4147bae4962b877eb66ca101750\" style=\"margin-bottom:var(--wp--preset--spacing--30)\"><strong><strong><strong><strong>Special cases \u2013 examinations after exposure<\/strong><\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"has-ast-global-color-8-color has-text-color has-link-color wp-elements-4051005eb34eb1da9169c1a063f5dafa wp-block-paragraph\" style=\"margin-bottom:var(--wp--preset--spacing--70)\">An additional employer\u2019s obligation arises if an employee has been exposed to carcinogenic factors or fibrogenic dusts. Even after employment has ended, a former employee has the right to an examination if they:<br>- have stopped working with hazardous substances,<br>- submit a request to continue medical care.<br><br>The employer is obliged to provide the examinations, cover their costs, and store the documentation in part C of the employee\u2019s personal records.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-ast-global-color-8-color has-text-color has-link-color wp-elements-1fe43c3cb28c4602dc676e01f16ba66a\" style=\"margin-bottom:var(--wp--preset--spacing--30)\"><strong><strong><strong><strong><strong>Duties of the employee and employer<\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"has-ast-global-color-8-color has-text-color has-link-color wp-elements-d866e6aed4018fab4381df3cc045aa0e wp-block-paragraph\" style=\"margin-bottom:var(--wp--preset--spacing--70)\">Both the employer and the employee have clearly defined obligations.<br><br><strong>Duties of the employer<\/strong><br>- issue a referral for medical examinations,<br>- ensure examinations are carried out on time,<br>- cover the cost of examinations,<br>- store documentation in personal files,<br>- not allow work without a valid medical certificate.<br><br><strong>Duties of the employee<\/strong><br>- undergo the indicated examinations,<br>- follow medical advice,<br>- attend examinations at the time specified by the employer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-ast-global-color-8-color has-text-color has-link-color wp-elements-274e0b36950dca76ea85caa121e33eea\" style=\"margin-bottom:var(--wp--preset--spacing--30)\"><strong><strong><strong><strong><strong><strong>Consequences of neglect and legal liability<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"has-ast-global-color-8-color has-text-color has-link-color wp-elements-fe7d0ba7bc0c6fcd10917d275dc54c96 wp-block-paragraph\" style=\"margin-bottom:var(--wp--preset--spacing--70)\">Failure to fulfil obligations by either party may result in:<br>a fine for the employer from PLN 1,000 to PLN 30,000,<br>- suspension of the employee from work,<br>&#8211; odpowiedzialno\u015bci\u0105 cywiln\u0105 w razie wypadku przy pracy bez wa\u017cnych bada\u0144.<br><br>W skrajnych przypadkach PIP mo\u017ce skierowa\u0107 spraw\u0119 do s\u0105du lub prokuratury. Dlatego tak wa\u017cne jest, by zar\u00f3wno pracodawca, jak i pracownik traktowali temat bada\u0144 profilaktycznych priorytetowo.<\/p>\n\n\n\n<p class=\"has-ast-global-color-8-color has-text-color has-link-color wp-elements-eea1f42acb0acc0972c972cab619238a wp-block-paragraph\" style=\"margin-top:var(--wp--preset--spacing--60);margin-bottom:var(--wp--preset--spacing--70)\">The types of preventive examinations are clearly defined by law. Each has a different purpose, but they all share the same goal: protecting the health and safety of employees. The employer must provide the conditions and cover the costs, while the employee is obliged to cooperate. Lack of examinations can result in serious sanctions, which is why it is important to ensure regular and proper implementation of health prevention in the workplace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>","protected":false},"excerpt":{"rendered":"<p>Preventive medical examinations are the foundation of workplace safety.
