Попередні медичні огляди — перший крок до працевлаштування
Initial examinations are mandatory for every employee before starting work. An employer cannot allow a person to work without a valid medical certificate confirming there are no contraindications to working in a given position.
The obligation applies to:
- newly hired employees,
- working conditions and harmful factors,
- молодих працівників, які змінюють посаду.
Виняток становлять особи, що повертаються на ту саму посаду до того ж роботодавця протягом 30 днів після закінчення попереднього працевлаштування.
Періодичні медичні огляди — моніторинг здоров’я під час роботи
Periodic examinations are mandatory for all employees and are carried out regularly. Their frequency depends on:
- the type of job position,
- working conditions and harmful factors,
- the individual decision of the occupational medicine physician.
The employer must ensure:
- examinations at the company’s expense,
- referral from your employer,
- the right to retain pay for the time spent on examinations.
Control medical examinations – after prolonged absence
Control medical examinations apply to people returning to work after an illness lasting more than 30 days. Their purpose is to confirm the ability to work in the previous position. As with periodic examinations:
- the examinations are carried out at the employer’s expense,
- they should take place during working hours,
- the employee retains the right to remuneration.
Without a valid medical certificate, the employee cannot be allowed to work.
Special cases – examinations after exposure
An additional employer’s obligation arises if an employee has been exposed to carcinogenic factors or fibrogenic dusts. Even after employment has ended, a former employee has the right to an examination if they:
- have stopped working with hazardous substances,
- submit a request to continue medical care.
The employer is obliged to provide the examinations, cover their costs, and store the documentation in part C of the employee’s personal records.

Both the employer and the employee have clearly defined obligations.

- issue a referral for medical examinations,
- ensure examinations are carried out on time,
- cover the cost of examinations,
- store documentation in personal files,
- not allow work without a valid medical certificate.
Duties of the employee
- undergo the indicated examinations,
- follow medical advice,
- attend examinations at the time specified by the employer.
Consequences of neglect and legal liability
Failure to fulfil obligations by either party may result in:
a fine for the employer from PLN 1,000 to PLN 30,000,
- suspension of the employee from work,

W skrajnych przypadkach PIP może skierować sprawę do sądu lub prokuratury. Dlatego tak ważne jest, by zarówno pracodawca, jak i pracownik traktowali temat badań profilaktycznych priorytetowo.
The types of preventive examinations are clearly defined by law. Each has a different purpose, but they all share the same goal: protecting the health and safety of employees. The employer must provide the conditions and cover the costs, while the employee is obliged to cooperate. Lack of examinations can result in serious sanctions, which is why it is important to ensure regular and proper implementation of health prevention in the workplace.
